Cream Counsel Pte. Ltd. (“CREAM”) will provide concierge services (“Services”) at your request. “Suppliers” are responsible for providing you with the services, products and Benefits (“Benefits”) you select, and as set out in our website. As a registered Member of CREAM (“Member”), you agree to abide by the following Terms and Conditions of Membership:

1. USAGE  
  1.1 Hours of Operation: Monday to Saturday, 9am to 10pm
  1.2 Your membership is personal to you, and is not transferable.
  1.3 As a Member of CREAM, you agree to produce your CREAM card or CREAM card number or other verification information to enjoy the Services and Benefits offered by CREAM on the request of CREAM or CREAM’s Suppliers of Benefits.
  1.4 In the event that your CREAM card is lost or stolen, you must notify CREAM immediately by e-mail at lostcard@creamcounsel.com.
  1.5 Please note that Suppliers of Benefits and the Benefits themselves may change from time to time without notice. If any of the Benefits become unavailable, we will do all we can to ensure prior commitments are honoured, but shall not be responsible for any actions of Suppliers outside CREAM’s control.
  1.6 CREAM will use its reasonable endeavors to satisfy requests to the best of our ability, but reserves the right to withdraw any of these Services and/or to refuse to supply the Services requested.
  1.7 When ordering a product or service or accessing a Benefit, you may be required to provide your Payment Card details. If you request and authorise CREAM to use your Payment Card in order to pay a Supplier for products or services, you acknowledge and agree that CREAM shall have no liability in respect of or be responsible in any way whatsoever in respect of the use of your Payment Card provided that CREAM acts in accordance with the instructions issued by you in relation thereto.
  1.8 On your instruction, CREAM may purchase goods or services on your behalf. In the event that it acts as a credit agent in this regard, you hereby authorise CREAM to deduct the credit sum from your Payment Card within 30 days of the payment date and to add any applicable credit card charges. All transactions above S$500 will require same day bank transfer of funds to CREAM.
  1.9 Sales are not completed or confirmed until receipt of valid funds. Once the payment transaction is completed CREAM will place an order confirmation with its Suppliers.
  1.10 Once the performance of a service has begun on your instructions, unless otherwise agreed by the Supplier, you shall not be entitled to cancel any services requested.
2. MEMBERSHIP FEES, CANCELLATIONS AND RENEWALS
  2.1 Membership fees are payable annually in advance after the application for membership has been accepted and approved.
  2.2 Your Membership fee is non-refundable. However, depending on the circumstances relating to any requests for cancellation, CREAM may, at its sole discretion, elect to refund your Membership fee in whole or in part.
  2.3 CREAM reserves the absolute right to cancel or suspend your Membership (at its sole discretion) for any reason whatsoever, in which event CREAM shall not be liable to the application for any claims whatsoever. If CREAM cancels your Membership, CREAM may (at its sole discretion) refund the balance of the unexpired period of the annual Membership fee.
  2.4 2 months prior to the expiration of your Membership, we will send you a renewal notification. On your confirmation to renew your Membership this agreement shall continue in force on the same terms and conditions herein.
3. LIMITATION OF LIABILITY
  3.1 Where CREAM supplies you with any goods or services supplied by a third party, CREAM will use all reasonable care in selecting the Supplier and ensuring the order is placed in accordance with your wishes. Where CREAM provides any representations or recommendations in relation to any of the information and suggestions comprised within the Services, you are deemed to be responsible for, and shall use your own skill and judgment as to, the quality, value and suitability of such information and suggestions in relation to deciding whether to enter into any arrangement or contract with any third party for the supply of services or sale of goods.
  3.2 CREAM will not be responsible for products and services offered by CREAM as agents for the Suppliers or for any aspect of the relationship between you and any particular Supplier. Unless expressly provided otherwise, all your rights and remedies are against the Supplier.
  3.3 CREAM shall have no liability to you for any loss, damage, costs, expenses or other claims for compensation arising from requests or instructions supplied by you which are incomplete, incorrect or inaccurate or arising from their late arrival or non-arrival, or any other fault of you.
4. MISCELLANEOUS
  4.1 We are committed to protecting your privacy, and will not disclose your information to anyone other than Suppliers and service providers connected with the execution of your Service requests. By giving CREAM your personal information you consent to this disclosure.
  4.2 CREAM may vary these Terms and Conditions from time to time. You will be notified of these changes in a timely manner by some or all of the following medium:

5. GOVERNING LAW
  5.1 This Agreement is governed by and shall be construed in accordance with the laws of Singapore and the parties to this Agreement submit to the exclusive jurisdiction of the Singapore courts to settle any dispute which may arise in connection or arising out or relating therewith.
